Property Transfers under either instrument will attract stamp duty concessions resulting in no stamp duty being paid.  Don't transfer property by a verbal agreement or indeed any written agreement which is not a Consent Order made by the Family Court or a binding financial agreement which complies with the Family Law Act.

We recommend that you don't attempt to prepare either of the documents yourself.  This can be a complex area of law and one which requires strict compliance with legislative provisions under the Family Law Act.  If your agreement or consent order is improperly drafted you may face litigation at some time in the future or alternatively face unintended consequences such as the payment of stamp duty or capital gains tax.
