Mediation, whilst now compulsory for childrens issues under the Family Law Act, is not
compulsory for property issues. However the Federal Magistrates Court will usually order parties to attend
private mediation during the course of the court procedures and before ordering a trial date.
The Family Law Act and Rules and the Family Courts expect that parties will exhaust avenues of
negotiation and mediation prior to commencing court proceedings.
Attempting mediation prior to commencing proceedings makes sense. You may very well resolve
all of your differences, or a least narrow the issues, avoiding unnecessary legal costs.
Mediation preserves relationships, particularly where there are children involved in the
separation. Your children will thank you for resolving your financial issues quickly and
amicably.
